In order to provide the Services on www.socialcloud.xyz (the “Site”), Social Cloud LLC with address: 7241 185TH Ave NE, UNIT 3231, Redmond, Washington 98073, USA, processes data of individuals (“Data subjects” / “You”), in accordance with this Privacy Policy. When processing personal data Social Cloud LLC complies with all applicable to its activities regulations on personal data protection.
By using any of our Services you consent to the collection, transfer, storage, disclosure, and use of your information and content as described in this Policy, including the transfer of this information to the United States, and/or other countries for storage, processing and use by Social Cloud LLC and its affiliates (if any). This includes any information you choose to provide that is deemed sensitive under applicable law.
Irrespective of which country you live in, you authorize us to transfer, process, store, and use your information in the United States and any other country where we and our affiliates or Service Providers operate or maintain facilities. In some of these countries, the privacy and data protection laws and rules regarding when government authorities may access data may vary from those in the country where you live.
We may revise this Privacy Policy from time to time. When making changes, they will be brought to your knowledge and published here. By continuing to access or use the Services after those changes become effective, you agree to be bound by the revised Privacy Policy.
Social Cloud LLC does not knowingly collect or solicit any information from anyone who has no legal right and capacity to enter into binding contract with us. You understand and agree that you alone control and are responsible for the posting of your information and other content you submit through the Services.
2.1. We collect the following information that you provide us directly: You decide whether and how to use the Services provided by Social Cloud LLC. In the forms through which personal data are entered, we indicate the mandatory or voluntary nature of the provision of data. The data, the completion of which is obligatory, are such, without which it is impossible to provide the respective Service or part of it. We collect:
- your basic account information upon registration: The use of part of the Services is possible after registration. To create your own account, you need to enter: first and last name, email address and password. In addition, information on registration and the provided consent to the Terms (date, time and IP address) is stored.
- data stored in your account and profile: Services provide the opportunity to create and/or store in your account information such as photos, CVs, cover letters, portfolio and/or other files. You decide for yourself whether and what data relating to you to store in your account on the Services. It’s your choice whether to include sensitive information on your profile. Please do not post or add personal data to your profile that you would not want to be publicly available. You agree not to store or send through the Services, in any form, information containing special categories of data and sensitive data such as racial or ethnic origin, political views, religious or philosophical beliefs, membership in unions, nor your genetic data, biometric data, data on your health, sexual life or sexual orientation, data related to your sentences and violations or identity documents such us PIN, passport / ID card number, etc.
- communications between you and Social Cloud LLC regarding service-related e-mails or messages.
- non-public direct messages between users: when you privately communicate with others through our Services, we will store and process your communications and information related to them.
- other data: Social Cloud LLC may process other data relating to you, in cases where you voluntarily provide such data by filling out appropriate electronic forms on the Services, adding preferences, settings and more.
2.2. We receive information related to the process of using the Services:
- Log files information: Our Services use log files for the purpose to ensure the reliable operation and security of the Services and to identify technical problems and detect malicious actions. When you use our Services, our servers automatically record certain log file information, including your web request, date and time of login to your account, Internet Protocol (“IP”) address, browser and device information, location, search terms, send electronic statements and other information. We use log-ins, device information and internet protocol (“IP”) addresses to identify you and log your use. Log file information is automatically reported by your browser or device each time you make a request to access our Services.
- Use of cookies: Cookies are information stored in your browser and used to save settings and identifiers required for some of the Services provided on the site. Cookies cannot collect personal data or other information stored on your computer or device. The use of cookies does not reveal your identity, but may lead to the identification of your device. You can use your browser settings to delete or disable the receipt of cookies from a particular or all sites. Currently we use only strictly necessary cookies for the Services to function.
Social Cloud LLC collects, uses and processes the information described above for the purposes provided in this Policy and in the Terms of Use of the Services, which may be: (i) conclusion and implementation of the contract for the provision of the Services between you and Social Cloud LLC; (ii) protection and application of the legitimate interests of other users of the Services, third parties and Social Cloud LLC; (iii) fulfillment of legal obligations of Social Cloud LLC; (iv) other purposes for which you have given your explicit consent.
When storing personal data, we apply the general principle of storing data in a minimum volume and for a period not longer than necessary to provide the Services, ensure their security and reliability and the requirements of the law.
We use all of the information we collect to help us provide and support our Services. We may use information that we receive to: (i) help you efficiently access your information after you sign in; (ii) remember information so you will not have to re-enter it during your visit or the next time you visit the Services; (iii) provide, improve, test, and monitor the effectiveness of our Services; (iv) develop our Services and test new features; (v) monitor metrics such as total number of visitors, traffic, and demographic patterns; (vi) diagnose or fix technology problems; (vii) prevent spam, fraud, or abuse and to promote safety and security of our Services.

By registering for and using the Services you consent to legitimize data transfers of information to the United States or to any other country in which Social Cloud LLC, our Affiliates or Service Providers operate or maintain facilities and the use and disclosure of information about you as described in this Privacy Policy.
Social Cloud LLC, our Affiliates, or Service Providers may transfer information that we collect about you, including personal information across borders and from your country or jurisdiction to other countries or jurisdictions around the world. If you are located in the European Union or other regions with laws governing data collection and use that may differ from U.S. law, please note that we may transfer information, including personal information, to a country and jurisdiction that does not have the same data protection laws as your jurisdiction. We use commercially reasonable safeguards to help keep the information collected through the Service secure and take reasonable steps to verify your identity before granting you access to your account. However, Social Cloud LLC cannot ensure the security of any information you transmit to us or guarantee that information on the Services may not be accessed, disclosed, altered, or destroyed.
Any information or content that you voluntarily disclose for posting to the Services becomes available to the public. If you remove information that you posted to the Services, copies may remain viewable in cached and archived pages of the Services, or if other Users have copied or saved that information.
We do not share or disclose your private personal information except in the limited circumstances described here: (i) with our Service Providers, which will be given access to your information as is reasonably necessary to provide the Service under reasonable confidentiality terms; (ii) in the event that Social Cloud LLC is involved in a bankruptcy, merger, acquisition, reorganization or sale of assets, your information may be among the items sold or transferred as part of that transaction. Then this Privacy Policy will apply to your information as transferred to the new entity as buyer or transferee will have to honor the commitments we have made herein; (iii) we may preserve or disclose your information in response to a legal request if we have a good faith belief that the law requires us to do so and that is reasonably necessary to comply with the law, regulation, legal process, or governmental request. This may include responding to legal requests from jurisdictions outside of the United States where we have a good faith belief that the response is required by law in that jurisdiction, affects users in that jurisdiction, and is consistent with internationally recognized standards; (iv) We may also access, preserve and share information when we have a good faith belief it is necessary to: detect, prevent and address fraud security or technical issues and other illegal activity; to protect the safety of any person, to protect our or our users’ rights or property, including as part of investigations; and to prevent death or imminent bodily harm; (v) when we have received your explicit consent to do so.
8.1. Right to information, access, correction and portability of your data
If you have registered an account, we provide you with tools and settings in your account to access, correct, delete or change the personal data you have provided to us and which are associated with your account. If you choose to provide us with personal information, we encourage you to update your information regularly to ensure that we have accurate and up-to-date information about you.

You have the right to request that we change, update or correct your data in certain cases, especially if they are inaccurate.

8.2. Data deletion
You may request that we delete or remove all or part of your personal data (for example, if we no longer need to provide the Services to you). We will make reasonable commercial efforts to honor your requests for cancellation. However, keep in mind that we may need to retain certain information for record-keeping purposes in order to complete requested services or fulfill our legal obligations.

If you have agreed to use information about you for a specific purpose, you have the right to change your mind at any time, but this will not affect the processing already performed. Please note that if you withdraw your consent, it will not affect the lawfulness of the use and processing of your information made on the basis of your initial consent before the moment of its withdrawal.
It is important to note that some services will not be available if you withdraw your consent or otherwise delete or object to the processing of some of your personal data.

We are committed to resolving well-founded complaints about your right to privacy and the collection or use of your personal data. It is recommended that you first address any questions or concerns regarding your personal information directly to us, and you also have the right to file a complaint with the relevant supervisory authority. If you choose to open a hyperlink link to a third party, you will leave our Services and be redirected to the third-party website. The fact that we link to a website does not constitute an endorsement, authorization or indication of cooperation with that third party, nor does it imply endorsement of their policies or practices for the protection of personal data or information security, which may differ from ours. These other websites may place their own cookies or other files on your computer, collect data or request personal information from you. Social Cloud LLC declares that it has no control over and assumes no responsibility for the content, privacy policies or practices of third party websites or services. We encourage you to review the privacy documentation of the third-party sites you interact with before allowing them to collect and use your personal information.

California Consumer Privacy Act (CCPA)
In addition to the rights documented elsewhere in this Privacy Policy, if you are a California Resident you have some additional rights under the CCPA. These include being informed of any of your personal data that has been “sold” (where sold for this purpose is defined below) and to opt out of the future selling of your personal data to third parties.

We do not intentionally, or knowingly, process personal information from individuals under the age of 18. When necessary, users under the age of 18 will be told not to submit any personal details. We will make every effort to delete any details of such users where a parent or guardian has informed us that these details have been collected.
